WHO AND WHAT WE ARE

The 10th Amendment Foundation is a grass roots, non-partisan, non-profit political educational corporation formed by citizens of the United States who are upset with the run-away violations of the Rule of Law (basically The united States Constitution) who want to find ways to restrain the Federal Government from exceeding the limited powers granted to it in the by the people and the sovereign states that united them in the founding instrument—the United States Constitution.

We believe that something must be done NOW if our children (whose liberties the United States was established to uphold under the preamble of the Constitution) are to avoid catastrophic consequences.

We believe that many of the problems currently confronting the country have been caused or made worse by the federal government’s exceeding its authorized power.

We believe the Constitution and the Bill of Rights state clearly the limited powers of our federal government and we seek to use all lawful means to restrain its actions to conform with those limited powers.

We also seek: (1) support from all like minded citizens through their contributions of ideas, advice and expertise to help refine and get our message out, (2) help with our mission of helping to educate every single citizen about the necessity of our limiting the Federal government as established under the Constitution if we are to maintain the freedom and liberty that the United States has come to represent throughout the world, and (3) help with tax free monetary donations to help fund the education of the people and public officials by Constitutional Advocates and media campaigns (without “preaching to the choir”) to spread the message with the ultimate goal of stopping the erosion of constitutional government and restoring freedom to the people of these United States.

In spite of recent Presidents, up to and including President Obama’s characterizing the Constitution as a “benchmark of our liberty”,  the Constitution has been shamefully ignored in the past by our Federal government, but never as much as it is being ignored today. The fact that it has been ignored in the past does not mean that we must continue to do so. If we are not successful in educating the electorate and our government officials as we plan and hope to do, we stand to loose our constitutional republic and our individual liberties.

The 10th Amendment to the Constitution (again, an essential part of the Bill of Rights”) states that the powers not specifically delegated in the Constitution to the federal government “are reserved to the States respectively, OR TO THE PEOPLE.” [EMPHASIS SUPPLIED] Yet in just the last four months our Federal government has taken action,  through the President or the Congress,  to far exceed any powers that were ever imagined to be granted by the constitution as recently as a year ago and far beyond anything ever imagined by those who have given up their lives to fight for and to protect our constitutional republic and our individual liberties.

In the future, this website will call upon all of our members to document any future violations of the 10th Amendment and the Constitution. However, today examples can be seen where branches of the Federal Government, which are supposed to be checks and balances on one another, have--in total violation of the intent of the writers of the Constitution--:

  • Injected themselves into private banking, forcing banks to grant sub prime loans that could not be supported by the market, thereby creating our present economic crisis
  • Fired the president of a non-governmental enterprise in violation of the 10th Amendment
  • Nullified secured contracts of private investors without due process, or reasonable compensation in violation of the 5th and 10th Amendments
  • Violated the franchise contracts of automobile dealers without due process or just compensation based upon nothing more than the fact that those particular franchise dealers contributed to the political opposition of the present governmental administration
  • Set up the means and regulations to tell private companies just how much they could pay their executive employees (without doing the same thing for athletes, movie stars, and labor union executives who supported their election if they could constitutionally do it in the first place); and
  • Assumed ownership control of a private enterprise in total violation of the 10th   Amendment

Now they are getting ready to expand their powers in violation of the 10th Amendment on an even  broader scale.   For instance, they are talking about a massive take over of the health care industry.  Under what stretch of the imagination can anyone realistically find a provision of the Constitution that gives the Federal government the right to control health care?  (It doesn't matter that  we already have Medicare and Medicaid and drug insurance. Those were other violations of the Constitution.  They are gone and no one tried to stop them. That was our fault and the "water in the kettle got a little hotter."  That cannot be an excuse for letting the inefficient Federal government take over, and then ration, and then destroy our national health care system.)  So part of our mission is to get as many of our members as possible to e-mail and fax letters to their Congressmen telling them that if the violate the Constitution again by voting for a takeover of our National Health Care system without first amending the Constitution to allow them to do it,  we will do everything in our power to see that everyone of their constituents knows that they have violated the "Rule of Law" on which our nation is based, and that they have openly and deliberately violated their oaths of office when they swore to uphold the constitution.

Even though federal officials who ignore the Constitution violate their oath to “uphold and protect the Constitution" and, thereby become subject to impeachment or recall, those processes are also difficult and less immediate than appealing directly to the people who may convince their Congressman and Senators to take another (or maybe a first) look at the Constitution and the 10th amendment.  If they will not, we want to help educate the people of the necessity to replace them with members of the House and the Senate who will. 

We are basically an outgrowth of the more than one million people who attended the grass roots "Tea Parties" across the country in April (and since).  The government controlled  press got it wrong when they thought that the "tea parties" were against taxes.  While we were against "taxation for the next generation without representation" in actuality we were (and continue to be) frustrated by run-away government--government that was not paying any attention to the basic documents on which our nation was founded and on which it was based for at least the first 200 years of growth and prosperity.


HOW WE ARE ORGANIZED

In order to be effective on the same national scale that we are experiencing in the present fascistic take-over of our constitutional republic, we must organize on a National scale. 

Therefore, we are planning and hoping to be able to establish local chapters in the vast majority of congressional districts throughout the country. (ACORN has well over 100 chapters) We now have a corporate structure under which 437 or more local chapters could obtain corporate structure and protection and 501 (c) (3) taxation limitation. 

The first chapter (and in most cases the only chapter) in each congressional district would be designated by the state and congressional district + 10th Amendment Foundation. Thus the local chapter in the 9th Congressional district of Virginia will be "The 9th VA 10th Amendment Foundation"  and the local chapter in the 1st district of Tennessee is "The 1st TN 10th Amendment Foundation"

The plan is to have each local chapter in the various states to come together to form their state's organization and the State organizations to come together as part of the national Foundation. Voting members (people who have contributed at least $100 during the year) will meet together in bi-annual tea parties to elect their officers and executive committees who will basically run their chapters until the next Congressional elections. The presidents or chairmen of the local foundations will make up the board of directors of their state foundation who will elect the state officers and presidents.  After November, 2010, the state presidents will make up the National Board of Directors. Until then, the initial Corporate Board plus local chapter presidents who have been recognized as having been fully organized will serve as the National Board.

There are certain restrictions on how one becomes an officer and/or board member to keep anyone opposing the 10th Amendment Foundation's "core beliefs" from "taking over" which might well be tried if we become effective. While we are non-partisan, such things have occurred in national political parties. That is also partially the reason for the high voting-member level of donation, but it is also felt that only those who really believe in what we are trying to do (at least to the extent of contributing $100 or more) should be eligible  to have an effective say in what we will be doing and how we are doing it. 

Similarly, there will be some restraints on each lower level by the higher levels to be able to prevent any local or state level of the Foundation to do something or say something that might seriously embarrass or harm the entire Foundation and members thereof.

The local organizations will agree to a charter agreement and will be approved by their state organizations (when we are sufficiently organized to have effective State organizations). 

In the meantime it is absolutely essential that we get moving as soon as possible, if we are going to have any hope of doing anything to help stop the juggernaut that is setting forth to totally replace our constitutional republic with a fascistic dictatorship.  For that reason we most strongly urge everyone who reads this and agrees with it to join us and become active in helping to organize the Foundation with us right away.  The "Tea Parties" are and have been a good way to get people together to express our frustrations and fear for the destruction of the Rule of Law in our great nation, but unless those of us who have expressed our frustrations and fears at the "tea parties" ( and those who feel the same way) do not organize and work together to try to stop the obamanation that is threatening to destroy what the founding fathers built and our fathers and brothers and sisters and sons and daughters have fought and died to protect, we will either have to take more drastic action or what they fought and died for will have been in vain.  

It is not enough to simply shake our heads in agreement with what was said at the tea parties or on this web page, or listening to Rush Limbaugh, or Sean Hannity, or other talk show hosts. If we are not ready to take up the banner now, they might well not be around to agree with in the not-too-distant-future.  We must organize now, and those who do not join us now will just have to sit around and watch our cherished freedom and liberty slip away. 

The Cherokee Indians around here have a story about the frog: If you put the frog into cold water and gradually heat it up, eventually he caught the frog will have it boiled and ready to eat. If you put the frog into boiling water, the frog will jump out and you will have nothing to eat. Looking at the analogy of the frog in the pot of hot water, the water has been brought almost to the boiling point. If we do not take real action now, our goose (or should I say frog) will be cooked!
